Season 1, Ep. 595

In this episode, Kiel Brennan-Marquez, Associate Professor of Law and William T. Golden Scholar at the University of Connecticut School of Law, discusses his draft article "Revitalizing Stare Decisis." Brennan-Marquez begins by explaining why the doctrine of stare decisis is in a crisis moment, and why he thinks that is a problem. He proposes an alternative way of conceptualizing stare decisis, and he explains why he thinks we ought to prefer it. Brennan-Marquez's scholarship is available on SSRN.
