Capano's Death Sentence Overturned, Fate Uncertain

Thomas Capano, a former wealthy lawyer in Delaware, has been granted a reprieve from the death penalty. The Delaware Supreme Court overturned his death sentence for the 1996 murder of his lover, Anne Marie Fahey. Prosecutors must now decide whether to retry the penalty phase to seek death again, or let Capano serve life in prison with no parole. The courts ruling was based on a 2002 U.S. Supreme Court decision, as the jurys vote for death was not unanimous. Faheys body was never found, and her family awaits the prosecutors decision.
