On vaccine safety, Kent says the movement has focused too much on parental choice and too little on the risks he believes parents need to hear about. His central question: If vaccines are described as safe, why do manufacturers have protection from certain lawsuits over vaccine injuries?
Kent points to the Supreme Court’s 2011 decision in Bruesewitz v. Wyeth. The Court held that the National Childhood Vaccine Injury Act bars state law design defect claims against manufacturers for injuries from covered vaccines. The opinion discusses the legal concept of “unavoidably unsafe” products.
